“Michal Cimbalak testified that he was working on a 20-foot retaining wall and building a foundation for a piece of equipment that Package Pavement was installing when he slipped and fell to the ground as he stood on a brace and poured the final pour,” says George W. According to Ilchert, Mr. Cimbalak sustained a herniated disc, a torn ligament, and a skull fracture as a result of the accident. Following the fall, he underwent cranial surgery and arthroscopic knee surgery. He sustained a traumatic brain injury, aphasia, cognitive disorders, and a seizure disorder and could not return to work following the accident. As a result of his injuries, Mr. Cimbalak receives ongoing care at the NYU Epilepsy Center and the Rusk Institute.
“Package Pavement maintained that although Cimbalak had sustained a serious injury, he had recovered well and was able to work,” says Ilchert. “They claimed that his seizures were controlled by medication and that his knee and back injuries were pre-existing.”
