Drone consultant, Stephen Myers, has filed an amicus brief in support of pilot Raphael Pirker, challenging the Federal Aviation Administration (FAA).
Online PR News – 03-July-2014 – Naples, FL – Southwest Florida based drone consultant, Stephen Myers, has filed an amicus brief in support of pilot Raphael Pirker, challenging the Federal Aviation Administration (FAA) for unfairly penalizing commercial drone consultants that are more trained and equipped than the unregulated hobbyist pilot.
Raphael Pirker made national headlines when he used a drone to film a commercial at the University of Virginia. In an attempt to make an example of Pirker, the FAA fined him $10,000 for reckless flight of an aircraft. Pirker successfully fought the charges in federal court, but the case remains in question as the FAA has appealed the ruling.
Myers disputes the FAA's authority to charge a civil fine against commercial operators of unmanned aircraft systems because the agency has not issued any rule that requires the pilots to follow all - or even a portion of - the Federal Aviation Regulations (FARs) that govern operation of manned aircraft. In absence of such a rule, the FAA's enforcement action against Pirker overstep the agency's regulatory authority.
Myers also contends that the commercial potential for the use of drone technology is being unjustly held back by the FAA. The administration maintains the position that commercial operations are effectively off-limits in the National Airspace System (NAS), which is contrary to the permissive approach to regulating hobbyists. Under current guidelines, hobbyists can fly unmanned aircraft systems - that are comparable in size and functionality of commercial systems - with little regulation and no enforcement.
The conflicting policies mean that companies like Myers' Angel Eyes UAV are prevented from flying commercial missions that are completely legal by an untrained hobbyist who is flying recreationally.
