Circuit) vacation of the U.S. Environmental Protection Agency’s (EPA) Cross-State Air Pollution Rule (CSAPR), which regulates emissions from upwind states that contribute to air quality problems in downwind states.

Stu Pearman, partner and energy practice leader said, “The D.C. District Court found that EPA over reached statutory authority in three areas: upwind state reductions not based on downwind impacts, lack of proportionality across upwind states, and ensuring the restrictions for the upwind states, taken together, do not over-attain vs. the standards. Moreover, The Court found EPA jumped the gun in going to Federal Implementation Plans (FIPs) to trump State Implementation Plans (SIPs). Per the Court, EPA's disapprovals of SIPs came before EPA specified state limits under the good neighbor provision.”

Mr. Pearman also said, “For owners of upwind state coal plants and planners of the grid, this is good news and bad. The good news is that the rules will be rewritten, giving helpful flexibility and time. The bad news is that uncertainty will persist, making long-range planning decisions more challenging, especially around transmission. Transmission planning in this environment is particularly tough, given its 10- to 12-year lead time. Also, transmission planners want to know what each of the generators will do as to retrofit or retirement and when. This will continue to be difficult.”
