According to the facts presented by Mr. Corsiglia, the 37 year old engineer went to his doctor with a four week history of cough. The doctor ordered a chest x-ray and it was misread as normal. The engineer was prescribed over the counter medication for the cough and post nasal drip.
Nine months later the patient returned after coughing up blood. The doctor elected to not order a repeat chest x-ray and once again ordered over the counter medications. Three months later, nearly one year after first complaining of the cough, the engineer was again seen for the cough but no chest x-ray was ordered.
Six months later, in early March 2011, the patient suffered a collapsed lung, went to the hospital emergency room and was diagnosed with stage four lung cancer and a two year life expectancy.
"Early diagnosis and treatment is the key to treating cancer. This delayed cancer misdiagnosis has lowered my client's chance of survival," said Mr. Corsiglia. The electrical engineer is married and has a 5 year old son.
Mr. Corsiglia contended that the first chest x-ray was misread and that it showed a suspicious lesion that should have been reported along with the recommendation to obtain a chest CT scan which would have led to the diagnosis of stage one lung cancer, which is curable. Instead, the cancer misdiagnosis resulted in a finding of incurable cancer.
