Employees from Paychex claim they were misclassified as overtime-exempt and denied overtime wages
Online PR News – 10-May-2019 – Rochester, New York – On Friday, May 9, 2019, two former employees (Plaintiffs) of Paychex, Inc. (Paychex) filed a class and collective action lawsuit (Case No. 6:19-cv-6347) against the company to recover unpaid overtime wages. Plaintiffs were hired to assist Defendant's clients with their payroll and benefits services. Plaintiffs were given the title of Implementation Coordinator and/or Implementation Project Manager. Despite their title, Plaintiffs allege that the work they performed was not aligned with project management, but rather routine customer service tasks.

Plaintiffs allege that Paychex violated the wage and hour provisions of the Fair Labor Standards Act (FLSA) by intentionally misclassifying them as salaried, rather than hourly employees. As a result, Plaintiffs claim that they and other similarly situated employees were denied overtime wages, even though the work they performed did not exempt them from the overtime requirements. Plaintiffs allege that they and other Implementation Coordinators and Implementation Project Managers simply performed routine customer service work that primarily consisted of answering inquiries from customers.
