ATM Metabolics Files Federal Lawsuit Against Holista Colltech for Breach of Distribution Agreement.
Online PR News – 06-February-2019 – Winter Haven, FL – ATM Metabolics, LLC ("ATM"), a leading research firm dedicated to the discovery of new and useful methods to improve metabolic and neurological functions headed by the renowned Dr. M. Joseph Ahrens, filed a lawsuit on January 24, 2019, against Holista Colltech Limited ("Holista") in the United States District Court for the Southern District of California. The lawsuit alleges, in part, that Holista breached the Exclusive Product Management Agreement and Distribution Agreement between the parties, which Agreement gave Holista certain rights to market and sell Emulin®, the revolutionary discovery which has proved instrumental in improving the lives of individuals worldwide. The Complaint asserts, in part, that Holista consistently failed to live up to its contractual obligations, including by failing to pay required license and royalty fees. In the lawsuit, ATM seeks monetary damages for Holista's alleged contractual breaches, along with findings from the Court that the Agreement has been terminated, and that certain restrictions on ATM and Dr. Ahrens in the Agreement are void and unenforceable.
"We look forward to proving our claims in Court so that ATM can start a new chapter and begin to empower individuals throughout the world by giving them access to Emulin®," said Dr. Ahrens.
