WTO Circulates EU's Intension to Strengthen Aluminum Migration in Toys

In December 2018, the WTO circulated a proposal by the EU to amend its Toy Safety Directive and strengthen migration limits for aluminum in toys.

Online PR News – 19-January-2019 – Geneva, Switzerland – The European Union has circulated proposals to strengthen its migration limits for aluminum in toys. Circulated by the World Trade Organization (WTO) in December 2018, the draft proposal will amend Toy Safety Directive 2009/48/EC and increase migration limits by about 2.5-fold in all categories of toy materials.

The three categories of material are:
• Category I - dry, brittle, powder-like or pliable
• Category II - liquid or sticky toy
• Category III - scraped-off

Under the proposals, the new migration limits (mg/kg) will be:
• Category I - 2,250 (previously 5,625)
• Category II - 560 (previously 1,406)
• Category III - 28,130 (previously 70,000)

This proposal follows a preliminary opinion by the Scientific Committee on Health, Environment and Emerging Risks (SCHEER), which was adopted as a final opinion in September 2017.

The document circulated by the WTO proposes the adoption of the draft Directive in the second quarter of 2019, with a date of entry into force in late 2020.
