The Supreme Court in TC Heartland v. Kraft Foods Group Brands has overturned a federal circuit law that permits patent litigation venue to be found wherever a defendant was subject to personal jurisdiction. The decision is changing the patent litigation landscape by significantly limiting the proper venue where patent infringement lawsuits can be brought. In effect, patent owners previously could bring patent infringement actions against domestic companies in almost any forum across the country, but that is no longer true under the Supreme Courtâ€™s narrower interpretation of the patent venue statute. Forum shopping in popular districts is expected to be dramatically restricted.
